These Terms and Conditions ("Terms") govern the provision of electrical services by Wire It Up Electric ("we," "us," or "our"), a licensed California electrical contractor (License C-10 #1114029), to you ("Client," "you," or "your"). By requesting, accepting, or receiving our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Important: These Terms constitute a legally binding agreement. Please read them carefully before engaging our services. If you do not agree with any part of these Terms, please do not proceed with service requests or contracts.
1. Service Terms
1.1 Work Exclusions
Unless explicitly stated in a written estimate or service agreement, our electrical services do not include repair or restoration work for:
- Drywall: Cutting, patching, finishing, painting, or texturing of drywall surfaces
- Stucco: Exterior stucco repair, patching, or refinishing
- Landscaping: Grass, plants, irrigation systems, or landscape restoration
- Roofing: Roof penetrations, flashing, shingles, or roofing materials
- Flooring: Tile, hardwood, carpet, vinyl, or flooring restoration
- Walls: Structural wall modifications, painting, or cosmetic finishes
- Other Trades: Plumbing, HVAC, carpentry, or masonry work
When electrical work requires access that affects these areas, we will create necessary openings to perform the electrical work. Restoration of these areas is the responsibility of the Client or must be arranged separately with appropriate licensed contractors.
1.2 Scope of Work
All electrical work performed by Wire It Up Electric will:
- Meet or exceed California Electrical Code (CEC) requirements
- Comply with National Electrical Code (NEC) standards
- Adhere to all applicable local building codes and ordinances
- Be performed by licensed, trained electricians
- Include proper permits when required by local jurisdictions
The specific scope of work for each project will be detailed in the provided estimate or service agreement.
1.3 Additional Work and Change Orders
Any work outside the original scope detailed in the estimate or service agreement requires a written change order. Change orders must:
- Be approved and signed by the Client before work begins
- Include a detailed description of the additional work
- Specify additional costs, materials, and timeline impacts
- Be documented and added to the project file
No additional costs will be incurred without your prior written approval. If unforeseen conditions are discovered during work that require changes to the scope, we will notify you immediately and await your authorization before proceeding.
2. Disclaimers
2.1 Troubleshooting and Unforeseen Issues
Electrical systems, particularly in older properties, can present unforeseen challenges. We acknowledge that:
- Some electrical issues may require significant additional investigative work to diagnose
- Certain problems may not be fully resolvable without extensive system modifications or upgrades
- Pre-existing conditions (including code violations, outdated wiring, or improper previous installations) may be discovered during service
- Hidden conditions behind walls, in attics, or underground may only become apparent once work has begun
Wire It Up Electric is not responsible for pre-existing issues or conditions uncovered during the job. When such issues are discovered, we will:
- Notify you immediately of the discovered condition
- Provide recommendations for addressing the issue
- Offer a separate estimate for any additional required work
- Await your authorization before proceeding with additional work
2.2 Equipment and Component Liability
Wire It Up Electric is not responsible for:
- Physical damage to electrical devices, panels, or wiring resulting from:
- Existing faults or defects present before our service
- Aged equipment that fails due to wear and deterioration
- Defective parts or components from manufacturers
- Improper previous installations by other contractors
- Environmental factors (water damage, pest damage, corrosion)
- Equipment failure that occurs after our service due to:
- Normal wear and tear of components
- Power surges or electrical events beyond our control
- Misuse or modification of our installed work by others
When we encounter equipment or components that appear to be failing or at risk of failure, we will inform you and provide recommendations, but we cannot guarantee the continued operation of aged or compromised electrical systems.
2.3 Code Compliance and Safety
While we ensure all our work meets current electrical codes, we are not responsible for:
- Bringing pre-existing electrical systems up to current code (unless contracted to do so)
- Code violations from previous work by other contractors
- Historical "grandfathered" installations that were code-compliant when installed but don't meet current standards
If we discover serious safety hazards or code violations during our work, we are obligated to inform you. Depending on the severity, we may be required to report certain violations to local building authorities per California law.
3. Warranty
3.1 Workmanship Warranty
Wire It Up Electric provides a 1 year warranty on all workmanship from the date of service completion. This warranty covers:
- Defects in our installation or repair work
- Failures directly resulting from our workmanship
- Properly installed connections that fail due to installation error
This warranty does not cover:
- Normal wear and tear of electrical components
- Damage caused by modifications made by others
- Failure of client-supplied materials or equipment
- Damage from power surges, lightning, or other external events
- Issues arising from failure to maintain the electrical system
- Consequential or indirect damages
To make a warranty claim, contact us at (916) 718-5979 or wireitupelectric@outlook.com. We will schedule a service visit to evaluate and address valid warranty claims at no charge.
3.2 Product and Manufacturer Warranties
Products, parts, and equipment installed by Wire It Up Electric are subject to the manufacturer's warranty policies. We do not extend, modify, or assume responsibility for manufacturer warranties.
- Product warranty terms, duration, and coverage are determined solely by the manufacturer
- Warranty claims for defective products must be filed according to manufacturer procedures
- We will assist in facilitating manufacturer warranty claims when reasonably possible
- Installation of replacement parts under manufacturer warranty may incur labor charges
We retain copies of product documentation and will provide you with manufacturer warranty information for major components upon request.
4. Payment Terms
4.1 Payment Schedule
Payment terms will be specified in your estimate or service agreement. Typical payment structures include:
- Small Jobs (under $1,500): Full payment due upon completion
- Medium Jobs ($1,500-$5,000): 50% deposit required, balance due upon completion
- Large Projects (over $5,000): Payment schedule detailed in project agreement (typically deposit, progress payments, and final payment)
- Emergency Service: Payment due immediately upon completion of emergency work
We accept cash, checks, credit cards, and electronic payments. Payment must be received before we release permits or final inspection documentation to the Client.
4.2 Late Payment
Invoices are due within 15 days of the invoice date unless otherwise specified in the service agreement.
Past-due payments will bear interest at 1.5% per month (18% per annum) until paid in full.
If legal action becomes necessary to collect unpaid balances:
- Client is responsible for all collection costs, including reasonable attorney fees
- We reserve the right to file a mechanic's lien against the property per California Civil Code
- Interest will continue to accrue on unpaid balances during collection proceedings
- Client may be responsible for court costs and filing fees
4.3 Deposits and Materials
Deposits are used to:
- Reserve scheduling and labor resources
- Purchase materials and equipment specific to your project
- Cover permit fees and inspection costs
Deposits are non-refundable once materials have been ordered or work has been scheduled, except as provided in Section 7 (Contract Changes and Termination).
5. Liability Limitations
5.1 Scope of Liability
Wire It Up Electric maintains professional liability insurance and workers' compensation coverage as required by California law. Our liability is limited to:
- Direct damages caused by our negligence in performing the contracted electrical work
- Amounts not exceeding the total contract value for the project in question
- Actual, documentable damages (not speculative or consequential damages)
We shall not be held liable for:
- Damages, losses, or costs arising from unforeseen issues related to aged wiring, defective parts, or other pre-existing conditions
- Consequential damages including loss of use, lost profits, or business interruption
- Damage to property caused by existing electrical faults discovered during our work
- Issues arising from client-supplied materials, equipment, or design specifications
- Delays caused by permit processing, inspection scheduling, or utility company requirements
- Force majeure events (natural disasters, extreme weather, pandemics, labor strikes, etc.)
5.2 Pre-existing Conditions
Many electrical problems stem from pre-existing conditions. Upon discovery of such conditions, we will:
- Document the pre-existing condition with photos or notes when feasible
- Inform you of the condition and its potential implications
- Provide recommendations for addressing the underlying issue
- Offer a separate estimate for correction if requested
We are not responsible for the cost of correcting pre-existing conditions unless such correction is explicitly included in the original scope of work or a subsequently approved change order.
5.3 Property Access and Protection
While we take reasonable precautions to protect your property:
- We are not responsible for damage to landscaping, lawns, or exterior surfaces required for access to electrical systems
- Client should secure or remove valuable, fragile, or irreplaceable items from work areas
- We will use drop cloths and protective measures, but cannot guarantee zero dust or debris from necessary access points
- Attic access may disturb insulation; crawlspace access may involve moving stored items
6. Dispute Resolution
6.1 Arbitration Clause
Any dispute, claim, or controversy arising from or relating to this agreement or the services provided shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.
Arbitration proceedings will be conducted in Placerville, California, or another mutually agreed-upon location within Sacramento County.
By agreeing to these Terms, both parties waive the right to pursue claims in court or through jury trial. The arbitrator's decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.
6.2 Attorney Fees and Legal Costs
In any legal action or arbitration proceeding arising from these Terms or the services provided:
- The prevailing party shall be entitled to reimbursement for reasonable attorney's fees and legal costs
- This includes costs of arbitration, court filing fees, expert witness fees, and related expenses
- The arbitrator or court will determine which party prevailed and the amount of recoverable costs
6.3 Governing Law
These Terms shall be governed by and construed in accordance with:
- The laws of the State of California
- The California Electrical Code (CEC)
- The National Electrical Code (NEC)
- California Contractors State License Law (Business and Professions Code Division 3, Chapter 9)
- Applicable local ordinances and building codes
7. Contract Changes and Termination
7.1 Modifications to Agreement
Any modifications to the service agreement must be:
- Made in writing through a formal change order
- Signed by both Wire It Up Electric and the Client
- Clearly document changes to scope, timeline, and costs
- Attached to the original agreement as an amendment
Verbal agreements or modifications are not binding. Only written, signed change orders will be honored.
7.2 Cancellation Policy
Client Cancellation:
- Cancellations must be provided in writing (email acceptable)
- If cancellation occurs before work begins and materials are not ordered, deposit may be refundable minus a 10% administrative fee
- If materials have been ordered or work has commenced, Client is responsible for all costs incurred to date plus 10% administrative fee
- Special-order materials that cannot be returned are non-refundable
Contractor Termination:
We reserve the right to terminate the agreement if:
- Payment is not received as agreed
- Client fails to provide necessary site access
- Unsafe conditions prevent work from proceeding
- Client engages in abusive or threatening behavior toward our staff
Upon termination by either party, Client will pay for all work completed and materials supplied to date.
7.3 Project Suspension
If a project must be suspended (due to permit delays, inspection holds, material backorders, etc.):
- We will notify you of the reason and expected duration
- Payment for work completed to the suspension point remains due
- Materials purchased for the project will be stored securely (storage fees may apply for extended periods)
- Timeline for project completion will be adjusted accordingly
- We will coordinate with you to resume work as soon as conditions allow
8. Permits and Inspections
Permit Responsibility:
- Wire It Up Electric will obtain all required electrical permits for work performed
- Permit costs are included in the estimate or billed separately as specified
- Client is responsible for providing accurate property information needed for permit applications
- Delays in permit approval by local authorities are beyond our control
Inspections:
- We will schedule required electrical inspections with local building departments
- Client must ensure access to the property for inspection appointments
- If work fails inspection due to our workmanship, we will correct the issues at no additional cost
- If work fails inspection due to pre-existing conditions or client-requested non-code-compliant work, correction costs are Client's responsibility
- Final payment may be withheld until inspection approval is obtained
9. Site Access and Working Conditions
Client Responsibilities:
- Provide clear, safe access to all work areas
- Ensure pets are secured away from work areas
- Disclose known hazards (asbestos, lead paint, structural issues, etc.)
- Maintain a safe working environment free from interference
- Be available or designate a representative for decision-making during work
Working Hours:
- Standard work hours: 7am-5pm (Monday-Friday)
- Weekend work: By appointment may be available by appointment
- Emergency service: Available 24/7 emergency service available
- We will respect reasonable noise restrictions and HOA requirements when communicated in advance
Power Outages:
Most electrical work requires temporary power shutoff. We will:
- Notify you in advance when power shutoff will be necessary
- Minimize downtime whenever possible
- Coordinate timing to reduce inconvenience
- Restore power as quickly and safely as possible
Client should make arrangements for temperature-sensitive items, medical equipment, home security systems, or other devices affected by power loss.
10. Insurance and Licensing
Wire It Up Electric maintains all required insurance and licensing:
California Contractors License: C-10 #1114029
General Liability Insurance: Yes - Current and Active
Bonded: Yes - Licensed Bond Current
Workers' Compensation: Coverage maintained per California Labor Code requirements
Proof of insurance and license can be provided upon request. We recommend you verify our license status at CSLB License Search.
11. Indemnification
Client agrees to indemnify and hold Wire It Up Electric, its employees, and subcontractors harmless from any claims, damages, or expenses (including attorney fees) arising from:
- Client's failure to disclose known hazards or property conditions
- Client's modification of our completed work without authorization
- Injuries to third parties caused by Client's negligence or property conditions
- Client's failure to maintain electrical systems after installation
- Claims arising from client-supplied materials, equipment, or design specifications
12. Changes to These Terms
Wire It Up Electric reserves the right to update these Terms and Conditions at any time. Changes will be effective immediately upon posting to this page with an updated "Last Updated" date and version number.
Existing Contracts: Changes to these Terms do not affect existing signed service agreements or contracts. Those agreements remain governed by the terms in effect at the time of signing.
New Services: New service requests, estimates, or contracts will be subject to the then-current version of these Terms.
We encourage you to review these Terms periodically. Continued engagement of our services after changes constitutes acceptance of the updated Terms.
13. Severability and Entire Agreement
Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement: These Terms, together with any written estimate or service agreement, constitute the entire agreement between Wire It Up Electric and the Client. They supersede all prior negotiations, representations, or agreements, whether written or oral.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or provisions.
